Research On The Investigation Power Of China's Supervisory Committee

Since the implementation of the National Supervision System Reform and the enaction of Law of the People's Republic of China on Supervision,the supervisory institution,as the exclusive subject executing the state's supervisory power,merges its work with the party's disciplinary inspection agency.The aforementioned mode has been continuously and comprehensively developed,and has received theoretical attention from the academic community.As one of the concrete practice carriers and basic operation methods of the state supervision power,the investigation power of supervisory institution has reshaped the structural system of national investigation power.The joint work mode with party's discipline inspection agency defines the investigation power of supervisory institution with the characteristics of affinity to the people,politics,authority,speciality and epochality.Such power is essentially different from the investigation power of specific matters(executed by the people's congress and its standing committee),the administrative investigation power,the judicial investigation power,and the criminal investigation power.It is a compound anti-corruption investigation power with political and legal duality.As a new type of investigation power,there are various problems during the its execution,such as inconsistency of regulations on supervisory investigation,indistinction of authority of the agencies executing supervisory investigation power,instability of operational procedures and insufficient guarantee of rights.Therefore,based on the theoretical and practical operation of supervisory investigation power,from the theoretical perspectives of law,political science,and party building,this article tries to clarify the authority of the agencies executing supervisory investigation power,improve the regulation system and operational procedures,and establish the system of supervisory investigation inquiry,objection and review.Such effort of this article is a useful exploration for the standardization and institutionalization of supervisory investigation power.
