Research On Regulation Of Internet Donation-based Crowd-funding

As a new financing model under the “Internet +” era,donation crowdfunding has developed rapidly and provided financing channels for individual help.However,unlike traditional charitable fundraising,it has its own characteristics and presents new problems.There are few theoretical studies on Internet donation crowdfunding in China,and it is not consistent with the existing legal system in China.The legal requirements have led to a lot of risk for Internet donation crowdfunding.On the one hand,there may be fraudulent donations from donor sponsors,which will harm the interests of donors.On the other hand,Internet donor crowdfunding platforms may have lax supervision,but they are in the gray area of legal regulation,and there is no corresponding responsibility mechanism to restrict them.Due to the low threshold of donation of crowdfunding,in recent years,there have been many fraudulent incidents using platforms such as “Easy to Raise”,such as donation of crowdfunding information fraud,and illegal use of funds raised later.These have a great negative impact on the healthy development of China's Internet donation crowdfunding business,so we should pay attention to it.This article focuses on the financing model of Internet donation crowdfunding.The first part first defines the concept of Internet donation crowdfunding,clarifies the difference between it and related financing models,analyzes the legal relationship among the participating entities of Internet donation crowdfunding,and points out the donation to the Internet.The necessity of crowdfunding for regulation provides a basis for theoretical analysis of this paper.The second part introduces the case analysis and summarizes the main legal problems existing in China's Internet donation crowdfunding.The specific performance is that there is no clear legal provision for Internet donation crowdfunding,the Internet donation crowdfunding platform is not strict,and Internet donation The patriotic fund management is opaque,and the Internet donation crowdfunding lacks after-the-fact relief system.The causes of these legal problems are mainly due to the lack of clear legislative norms for Internet donation crowdfunding,the imperfect regulatory mechanisms,and the failure of all entities to assume their due responsibilities.The third part is mainly to put forward corresponding suggestions for the problems arising from Internet donation crowdfunding.By referring to the operation mode of the donation crowdfunding platform of relevant countries outside the domain,the enlightenment of the legal regulation of Internet donation crowdfunding in China is obtained.Finally,specific legal regulation recommendations are proposed for China's national conditions.It mainly elaborates on four aspects: improving the legislation of Internet donation crowdfunding in China,clarifying the responsibilities of all stakeholders of Internet donation crowdfunding,improving the supervision mechanism of Internet donation crowdfunding,and strengthening the construction of social credit system.Hope can propose a specific regulation of Internet donation from a legal perspective,and promote the healthy development and effective operation of donation crowdfunding.
