Food Security Crime Control

The problem of food safety is not only related to the food production enterprises,but also related to the whole society. Nowadays, food safety crimes happen veryfrequently in our country, and they do serious harm to our health and social stability.So it is necessary to intensify the prevention and punishment of food safety crime.There are two reasons that I use the theory of crime control to explore how to reducefood safety crime. One reason is that crime can be controlled in some extent, but cannot be completely wiped out. the other one is that the administrative supervisions andcriminal legislations on food crimes are not perfect. According to the theory offamous German jurist Franz von Liszt,“the best social policy is the best criminalpolicy”, this paper tries to establish a food safety crime control system in whichsocial control is the primary choice and the legal control is the secondary choice inorder to maximize the control of food safety crime.There are three parts in this paper.In the first part, it discusses the concept of food safety crime in view ofcriminology, and makes a brief description about the current situation of food safetycrime in our country. Then the essy expounds the theory of crime control anddiscusses the possibility of the control of food safety crime.In the second part, basing on “moral-the first law(food safety law)-the secondlaw(criminal law)”, it introduces the current food safety crime control measures andits existing problems from the following three aspects, food safety administrative supervision system, criminal legislation and regulations and the present condition ofthe convergence mechanism of administrative law execution and criminal justice.In the third part, it tells how to rebuild the food safety crime control system withsocial control and legal control. The social control includes improving the supervisionof the administrative department of food safety and strengthening the supervision ofnews media and the public and reducing crime motives of the food producers andtraders. The legal control is to consummate the food safety criminal legislation andcriminal justice.
