A Research On The Protection Of The Rights Of The Subjects In Public Credit Information

With the development of economy and society,building credit in China and social credit system is an important foundation of the development of economy and society.On the other hand,we can collect and utilize the public credit information to promote the social credit system.In2019,the government work report mentions "sound social credit system",so the construction of credit system has become a key topic closely related to the people,and it is the fundamental solution to rectify and standardize the order of market economy.However,credit rating industry in China has been a late starter,the laws and regulations of the public credit information is not complete.Some pertinent items are not specific enough,and the protection of the rights of the subjects in credit information is missing,so it is a new problem in the development of the social credit system.According to the new problem,we should do something both protecting of the rights of the subjects and promoting the development of the social credit system.These have become the problems that must exist and need to be solved in the development and construction of public credit information.The protection of the rights of the subjects in public credit information is a huge systematic project,which includes all aspects in the system design.With reference to foreign advanced practices,when we improve legislation,we should not only pay attention to the collection,sorting and use of information,but also the content of dissent and relief.When we establish and improve the standardized management of credit information so as to realize the purpose of maintaining the rights and interests of information subjects.This paper mainly focuses on the social attribute of information right of information subject,reasonable information collection system and internal remedy for information subject’s rights and interests.This paper is divided into four parts from the structure: the first part,the main body of public credit information rights and interests of the theoretical basis;The second part analyzes the current situation and causes of the protection of the rights and interests of the subjects of domestic public credit information.The third part,taking the United States and Shanghai as examples,introduces the legislation and experience on the protection of the rights and interests of the subjects of public credit information.The fourth part,based on the construction of the legal mechanism of publiccredit information,puts forward countermeasures and Suggestions for the protection of the rights and interests of the subjects of public credit information.Through the above four parts,combined with the current situation of the construction of legal mechanism related to public credit information,we can do the research.This paper uses reading literature,data analysis,comparative study and theoretical analysis to research in the social credit system.Finally,this study alse offered some relevant suggestions based on the research.
