Study On Optimizing The System Of Prisoners Temporary Leaving To Visiting Family In Provincial Prisons Of Guangzhou

As a state organ,prison is the national penalty executing organ,which executes punishment and reformation,effectively prevents and reduces crime,and ensures social security and stability.In the process of prison management,discussing punishment and education,law enforcement and care,and exploring the combination of strict law enforcement and people-oriented management are conducive to innovating prison management methods,improving reformation effect and conforming to the law of social development.As a prison management measure and administration reward,leaving prison temporarily to visit relatives is an important means to embody the civilization of penalty execution and strengthen the effect of criminal reformation under the social background of deepening the construction of rule of law and strengthening the concept of rule of law in our country,which has attracted more and more attention from all walks of life.Through sorting out the development context of the implementation of visiting relatives from prison,understanding the practices of other prisons at home and abroad,this paper analyses the characteristics of the system of visiting relatives from prison and special permitted visiting relatives from prison,clarifies the conditions for examination and approval and implementation process,and studies the system of visiting relatives from prison in depth by using the theory of socialization of criminal execution,the theories of human rights protection of criminals,risk management and ERG incentive.This paper introduces the development and the implementation of the system in the provincial prisons of Guangzhou.It comprehensively uses the methods of literature analysis,comparative research and questionnaire survey,and combines with specific practice to analyze the effect of the system implementation,summarizes the implementation effect and influencing factors of the system,and makes a systematic reflection on the system of leaving prison and visiting relatives.Finally,it puts forward its own countermeasures and suggestions on how to optimize the system of leaving prison and visiting relatives.By setting clear objectives and positioning of the work of leaving prison and visiting relatives,we can determine the direction of the system;by improving the laws and regulations of the work of leaving prison and visiting relatives,we can improve the risk management system to ensure the orderly implementation of the work of leaving prison and visiting relatives;by optimizing the implementation environment,introducing incentive system of rewards and punishments,we can promote the sound development of the work of leaving prison and visiting relatives.This paper insists on the combination of theory and practice,analyses the root causes of the problems,puts forward suggestions for optimizing and perfecting the system of visiting relatives from prison,provides reference for decision-making of management,promotes the standardization,long-term and effectiveness of the implementation of the system of visiting relatives from prison,and promotes the transformation of prisoners from curing symptoms to curing root causes through the role of "sending back one person and influencing a group of people" from prison.
