Study On Improving The System Of Leaving Prison And Visiting Relatives

As an important part of the State apparatus,prisons are also the penal enforcement agencies of the State,which are able to exercise a function of punishment and rehabilitation for prisoners,while effectively preventing and reducing crime and ensuring social stability.In the process of managing criminals,we need to punish and educate them,as well as to carry out law enforcement and care,so as to combine rule by virtue with the rule of law and innovate prison management methods so as to be able to improve the effect of transformation,which is in line with the development law of the whole society.leaving prison and visiting relatives is a reform measure of prison management,which reflects the continuous deepening of the construction of legal system in China and the innovation of management A result,but also reflects the current criminal law enforcement civilization of an important stage,attracted the attention of all sectors of society.Leaving prison and visiting relatives has a historical background and profound cultural foundation in our country,which is an important means to mobilize criminals to actively reform and promote the smooth return of criminals to society.However,the system of leaving prison and visiting relatives is not ideal,and there are many problems to be solved.In view of this situation,this paper puts forward effective countermeasures from four aspects: legal and regulatory system construction,operation mechanism,supervision mechanism and publicity mechanism.Based on the current research situation of the relevant system at home and abroad,this paper uses literature research method and comparative research method,combines four theories,such as the socialization of execution,the humanitarianism of execution,the humanized management and the value of efficiency of execution,and also draws lessons from the present situation and characteristics of similar system abroad,get the problem in the application rate,operation mechanism,supervision mechanism and public opinion.The essence of finding the problem is to solve the problem,so this paper analyzes the causes behind the imperfect system of leaving prison and visiting relatives,including imperfect system of laws and regulations,lack of top-level design,lack of supervision mechanism and insufficient publicity.Based on this paper puts forward on the improvement countermeasures from five aspects: law system construction,operation mechanism,supervision mechanism and publicity work mechanism.First of all,to strengthen the legal construction,it is necessary to make a detailed definition of the nature,conditions,objects and time of leaving prison and visiting relatives.Secondly,promote the construction of legal system from the level of regulations and normative documents.The third is to rationalize the operation mechanism of leaving prison and visiting relatives by improving the joint assessment mechanism and establishing a perfect linkage mechanism between prison and local.The fourth is to strengthening the supervision mechanism of leaving prison and visiting relatives can effectively reduce the supervision risk the period of leaving prison and visiting relatives,which is the key to ensure the smooth operation of the system of leaving prison and visiting relatives.It is necessary to systematically investigate,seamlessly connect,linkage disposal and strengthen supervision.The fifth is to establish and improve the propaganda mechanism.This paper makes a comprehensive analysis of the significance and existing problems of the system of leaving prison and visiting relatives,and puts forward some countermeasures to improve the system,which has certain theoretical and practical significance for the prison management level in China.As one of the specific means of education and reform to carry out the new pattern of five reforms,the work of leaving prison and visiting relatives should have assumed the functions of guiding criminals to repent at their sins,encouraging criminals to reform,special prevention of crimes,resolving social contradictions,arousing social concern and recognition.Prison workers should base themselves on prison,focus on all sectors of society,stand at the height of constructing "big education" pattern to innovate the way and method of planning the work of leaving prison to visit relatives,and show its comprehensive efficiency.
