A Study On The System Of Rehabilitation For Juvenile That Serious Harm To Society

In recent years,juvenile delinquency is on the rise,the bad influence of the case,the frequency of cases,the younger age of crime and the frequency of media reports have made more and more people to concern them.According to the law,a minor under fourteen years of age don't bear any criminal responsibility,this kind of people in some cases don't bear any criminal responsibility even any punishment.They commit crimes after economic compensation,part of them commit crimes to the families of the victims.The public is worried about it.The General Principles of the Civil Law of the People's Republic of China has reduced the age of limited capacity for civil conduct from "10 years old" to "6 years old".With the development of economy and society,the life and education level have been improved,the mental maturity and cognitive ability of minors are improved.Appropriate reduction of age is beneficial to their engaging in civil activities adapting to their age and intelligence,so it can respect the self-consciousness of this part of minors and protect their lawful right and interests much better.As a result,people discuss the requiring a lower age of criminal responsibility.In view of the above background,the author analyzes current measures taken in China,the results achieved and the shortcomings of existing practices.The author thinks that we should not blindly take measures to reduce the age of criminal responsibility,and we should take measures to accept education for minors who are seriously harming the society.Juvenile delinquency is only a mirror of social development.Minors' weak bearing capacity,vulnerable to environmental influences and low control ability make the various contradictions of social transformation finally embodied in the juvenile groups.This is also the primary reason that the social issues of minors become more and more heated discussion even the reform and opening up policy has been released more than 30 years.The solution of social problems still needs long-term unremitting coordination and rectification,let alone the problem of juvenile delinquency.Any attempt to solve the problem through the "quick" approach is not applicable,because we cover up a problem will spawn more new problems.Therefore,it is necessary to do a comprehensive combing and consideration of the educational and correctional system applicable to juveniles in contact with the law.The existing system of correctional education in our country is too general,vague,it is difficult to achieve the purpose of correction.The author puts forward conception to improve the system of correctional education from the development of the system of correctional education,defects and serious harm to society,the characteristics of juvenile crime.The author offers a proposal to improve the system of correctional education on the legislative pattern,the used condition and object,the execution place and the way,the judicial procedure and the supervising institution.Hope to be able to reform and improve the correctional system.
