Research On Legal Countermeasures Of Accurate Poverty-relief In Rural Areas

The accurate poverty-relief requires precision in six aspects,such as,Accurate identification method,Accurate project arrangement,Accurate use of funds so on.Thus,.we can the precise poverty alleviation work achieve the greatest benefits,It reduces the number of poor people in our country.This paper analyses the existing problems in accurate poverty-relief in China,and expounds the corresponding solutions based on the analysis of the existing normative documents and local laws and regulations on accurate poverty-relief,and combined with the practical situation of the author.There are four parts in this paper,the first part is the constitutional basis of targeted poverty-relief in China.It mainly discusses that targeted poverty-relief is the guarantee of the survival and development rights of the poverty-stricken objects.Moreover,Chinese citizens have the right to get help from the state according to the provisions of the constitution of China.The second part is the normative analysis of targeted poverty-relief,including the normative basis and current situation of targeted poverty-relief.At present,the basis of targeted poverty alleviation at the national level is mainly normative documents issued by the CPC central committee,the state council and various parts of the country,lacking unified legislation at the national level.Local laws and regulations are mainly enacted in different regions,but the legal effect is low and there are similarities in structure.The third part is the analysis of the existing problems of targeted poverty alleviation.The author believes that in theprocess of targeted poverty alleviation,there are mainly problems such as unclear responsibility of the main body of poverty alleviation,imperfect cooperation mechanism between the government and social organizations,unscientific identification mechanism of targeted poverty alleviation,lack of supervision mechanism and judicial relief mechanism of targeted poverty alleviation,and lack of protection of rights of poor households.The author proposes solutions to the problems discussed in the fourth part.The author believes that solutions can be made from the following aspects:defining the main responsibility of poverty alleviation,establishing legal constraints on the cooperation between the government and social organizations,reforming the identification mechanism of targeted poverty alleviation objects,improving the supervision mechanism and improving the grass-roots legal service system.
