Study On The Legitimacy Of Administrative Normative Documents

As a very traditional and important means of government governance,administrative normative texts are widely used in practice.Compared with laws and regulations,administrative normative documents are more specific,clear,and more operable.They are often an important basis for governance in specific administrative activities.In addition,my administrative legislative power is limited to prefecture-level governments.The working departments of county-level,township governments and local governments above the county level do not have this power,and the realization of the government's social management functions can not be separated from abstract rules.As a result,a large number of administrative normative documents will be spawned,and their quality will have a major impact on the effectiveness of social governance.In recent years,the state has paid more and more attention to the supervision of administrative normative documents,and their quality has been significantly improved and strengthened.However,the phenomenon of random texts and "strange" documents issued by individual regions and departments still exists to varying degrees.This has caused dissatisfaction among the masses and has also greatly damaged the credibility of the government.There are many reasons for this,but the imperfection of the procedure for formulating administrative normative documents is animportant reason for the problem,and with deep concern about this issue,this paper intends to take legitimacy as the research perspective and administrative normative documents as the topic.Firstly,expound the basic principle of proper procedure of administrative normative documents;Secondly,by summarizing and collating the basis for the formulation of administrative normative documents at or above the provincial level,we will closely focus on the three judgment elements of legitimacy and analyze the current situation and problems of the procedural legitimacy of China's administrative normative documents.Finally,the author puts forward some countermeasures and suggestions to improve the legitimacy of administrative normative documents.
