Medicine is a kind of commodity related to the human health and life security,and the drug patent system is also the most sensitive one in the legal system.It can encourage innovation and promote the pharmaceutical research,and meanwhile it may lead to drug accessibility problems,since the drug price is pretty high during its patent life,making poor people could not get effective drugs,which caused much controversy in human rights.So the drug patent system is not only an important legal issue,but also a complex social proposition.It's one-sided to explore the law only from the aspects of human rights and public interests.Firstly,medicines are not only life-saving drugs,but also commodities with economic significance and economic operation mode.The incentive nature of the patent system is also related to the stimulation generated by economic rewards.Secondly,the academic circle usually balances private interests and public interests from the perspective of human rights ethics,which involves discussions on ethics.This paper will seek a new method to interpret ethical issues such as human rights and justice in the drug patent system.Also,as the world gradually merging into one,the law occupies an important role in the progress of globalization,especially the drug patent system which influenced by the transportation of drugs involving trade exchanges and R&D investment.The political dialogue is also necessary to comprehend the drug patent system,since the various power and right contests and complex political games.So there are many games of legal value in the drug patent system,which is not only the simple formulation of rules by legislators,but also contains various complicated propositions.And the improvement of this system is also affected by the social changes and development,as well as the compound effect of various factors.Only through multi-angle analysis can we have a clearer understanding of the emergence and operation of a system.This article will focus on the economic,ethical,political and other propositions of the drug patent system.It is hoped that this comprehensive jurisprudential analysis method will sort out relevant factors from a more diversified perspective,explore the inherent legal principles of the drug patent system.
