Empirical Study On The Liability System Of International Air Cargo Carriers

With the continuous expansion of the scale of international air cargo,the treaties and regulations regulating the order of air cargo are constantly being improved.In the international air cargo transportation responsibility system,the carrier's responsibility can be said to occupy the core position.Compared with the international convention on the regulation of carrier liability,China's current international air cargo carrier liability system still needs to be improved.This paper mainly uses the "Warsaw Convention" and the "Montreal Convention" as the research carrier,focusing on the empirical analysis of the main system,the scope of responsibility system and the liability limitation system in the international air cargo transport carrier liability system.The article gives an empirical analysis of the specific content of how to identify the responsible party,determine the liability period,determine the damage of the goods and the limitation of liability in the international air cargo transport carrier liability system,and proposes the current existence of the carrier liability system in China.Limit the narrow scope of the carrier,the unclear status of the freight forwarder,the inconsistency between the criteria for determining the elements of the liability period and the international conventions,and the low compensation standard for the liability limit,and propose suggestions for the existence of these problems,including narrowing the scope of the subject Issues,legislation and regulation of air cargo agency systems,integration of domestic laws and international conventions,etc.,with a view to improving China's air cargo transport carrier liability system.
