| Community correction as a penalty by the rapid development of foreign way,in our country is becoming more and more attention,at the end of 2016 the state council issued "the community correction law(draft)",community correction under the rule of law standardization process back into a rapid development period,but after ten years of operation,at the present stage our country community correction system has exposed the low legislative level,each department cohesion is imperfect,the law enforcement main body are not identified.To solve these problems not only to organ diseases of their own,should also rely on supervising organ of external force,driven by outside the community correction system and supervision and the development of community correction,both of the intimate interaction and connection.But in the current judicial practice in our country,the legal supervision on community correction itself also has certain problem and need to improve,such as lack of special legal norm and coercive power supervision,procuratorial organ itself also exist problems of insufficient recognition of community correction.This article first chapter through to the community correction and community correction paper summarizes the definition and features of legal supervision,it is concluded that community correction legal supervision for the importance of community correction,the second chapter throughpractice found in the list of community correction and problems existing in the supervision of community correction,the third chapter is outside the community correction and the development of the community correction supervision and relatively mature legislation system and organization setup,find worth our using for reference of merit,the fourth chapter from the community correction and community correction supervision legislation perfect,mechanism construction and hardware supporting three aspects come to the conclusion that our country improve the system of community correction and countermeasures of community correction legal supervision. |
