On The Enactment Of The Civil-military Integration Law

The development of civil-military integration means that the country deeply integrates national defense and military modernization into the national economic and social development system,and realizes the resources of the two major military and civilian systems: national defense science and technology industry,weaponry,personnel training,socialization of military support,national defense mobilization,etc.The optimal allocation of fields will promote the positive interaction and coordinated development of economic construction and national defense construction,and realize the process of enriching the country and strengthening the military.The author believes that the good operation of the system requires the effective protection of the law.Combining with China's long-term lack of macro guidelines for top-level design and the current status of a special military-civilian integration and development legal system,military-military integration as a long-term and complex system project only relies on policy guidelines.Without the strong guarantee of law,it is difficult to ensure the sustainable and stable operation of the military-military integration development strategy.The United States,the European Union,and Russia have achieved good results by enacting the basic laws governing the integration of military and civilians and regulating the integration of military and civilian development management systems and safeguard measures.China's promotion of military-military integration should draw on the successful experience of the United States and other civil-military alliances.The National People's Congress StandingCommittee issued a unified basic civil-military development law that provides a framework for the basic principles,leadership mechanisms,specific measures,and legal responsibilities for the integration of military and civilian development.The article discusses the following three aspects.The first part digs deeper into the theoretical origins of "military-military integration",fully demonstrates the necessity of military-civil integration in the process of human society development,summarizes the legislative history and legislative status of China's military-civilian integration development,and analyzes The second part compares the development of civil-military integration in the world's major countries and the status quo of legislation,sums up several models of the foreign-military-military integration law,and seeks lessons for the construction of the Chinese civil-military integration legal system.In the third part,in accordance with the relevant ideas and principles of jurisprudence,legislative objectives and legislative measures are proposed in terms of market integration requirements,technological integration requirements,capital integration requirements,and the integration of basic conditions,etc.The legislative principles of "coordinated development,efficient and convenient use,and effective use of supervision and evaluation" have been proposed in three areas,from clarifying the integration of military and civilian leadership mechanisms and departmental responsibilities,and establishing basic systems for the development of civil-military integration in various fields and setting up scientific and strict legal responsibilities.
