Study On The Problems And Countermeasures Of Public Participation In Housing Expropriation

Public participation in the expropriation of houses on state-owned land is beneficial to promoting the process of state-owned land acquisition,easing social contradictions,coordinating the deviation of interests between different entities,improving the level of security and people's livelihood,strengthening and innovating social governance,and enhancing people's sense of happiness and security.Based on the evolution process of house expropriation system on state-owned land,this paper explores the necessity and rationality of public participation in house expropriation on state-owned land from the perspective of property rights theory and new public management theory.Then,using game theory to explore the game process between the local government,the public and the house expropriation department in the house expropriation on the state-owned land,and analyze the status quo and problems of the house expropriation on the state-owned land after the local government monopolizes the discourse power based on the self-interested motive.Subject to the differences in the social status and access to information of the participating parties,the game of non-complete information in the collection of state-owned land is more obvious,and the mode of public participation is non-institutional,the scope of public participation is narrow,the depth of public participation is insufficient,and public participation is involved.The procedural justice is the main problem facing public participation in the current house levy on state-owned land in China.A comprehensive analysis of the internal and external environment of state-owned land acquisition shows that the judicial relief is inadequate,the monopoly of local government's voice,the unscientific setting of public participation procedures,and the restrictions of game rules are the main causes of these problems.Therefore,public participation in the promotion of housing expropriation on state-owned land should first strengthen the top-level design from the system construction and improve the external environment for public participation.Secondly,it is also important to avoid self-interested interests and influence local government decision-making and specific implementation procedures,improve public participation procedures,and build two-way information distribution channels between local governments and the public.The effectiveness of improving the game of public participation can be started from the two levels of direct stakeholders and indirect stakeholders and the government.In addition,a sound judicial relief system is also an important guarantee for public participation in state-owned land.
