Legal Measures For The Protection Of The Overseas Interests Of China Under "The Belt And Road"

With the further development of the "The Belt and Road" initiative,the overseas interests of China are expanding worldwide with an astonishing speed and breadth."The Belt and Road " has brought unprecedented opportunities for the development of China,and has also increased the risks of the overseas interests.We must recognize the importance of legal protection of overseas interests,and analyze the problems existing in it to improve the legal protection measures under the framework of "The Belt and Road ".This paper uses the theory of national interest to define the concept of overseas interests.The overseas interests under "The Belt and Road" are an important component of the national interests.It has unique attributes such as diversity,international and sharing.The scope of it mainly includes political,economic and personal interests.The necessity of protecting our overseas interests under "The Belt and Road" is obvious.It is not only to cope with the risks brought by the special environment along the "The Belt and Road",but also to ensure continuity and openness of the initiative.It is necessary to create a stable environment for the economic development of China,while attracting more countries to join the "The Belt and Road" and to protect our enterprises and citizens.At present,we have remarkable achievements and also have many problems.This article analyzes the status of overseas interests protection.And starting with the deficiencies of the diplomatic protection system of China,bilateral investment agreement system,dispute settlement mechanism,police liaison mechanism and other legal systems to analyses the problems existing in the legal protection of the overseas interests.In view of these problems,this article puts forward suggestions for improving the legal protection measures of the overseas interests under the framework of "The Belt and Road".It includes improving bilateral investment agreement system,building a diversified dispute settlement mechanism,a police liaison mechanism and relevant legal system on the basis of diplomatic protection system.
