In recent years,along with the wave of continuous changes and developments in Internet technology,the development of e-commerce has greatly expanded the possibility boundary of transactions.Among them,the impact on the lifestyle of the whole people is a change in payment methods.As a new form of payment,third-party payment has greatly changed people's trading habits.The convenience of cashless operation has made third-party payment in the early stages of development,and its rapid market appeal has been rapidly promoted.Everyone's life has had a profound impact.This paper focuses on the network payment situation of third-party payment,analyzes the types of criminal risks arising from the third-party payment generation,operation and transaction links,attempts to analyze the causes of criminal risks in depth,and finally proposes third-party payment based on international useful experience.Helpful advice on criminal risk regulation.The third-party payment industry is booming.On the one hand,it provides strong support for the stable and healthy development of the economy,and brings convenience and convenience to people's lives.On the other hand,huge risks are also hidden,such as technical loopholes in the industry,regulatory loopholes,and Legal loopholes provide criminals with a hotbed of criminal activity.Although the central bank of the competent authority of the third-party payment institution has issued a series of regulations to restrict the parties,the criminal risk problem of third-party payment remains due to the problem of payment technology loopholes,inadequate administrative supervision system and imperfect criminal regulations.Very serious.For more targeted discussion,the case analysis method will be used to intuitively introduce the criminal risks of different links under the third party payment,and focus on the criminal risk of typical transaction links.Finally,the comparative research method can be used to learn from the excellent experience of other countries.In combination with the actual situation in China,it proposes more comprehensive and targeted regulatory measures.The various parts of this paper are based on the following ideas: The first part starts with the basic knowledge of third-party payment,understands the development history,specific concepts and the main two behavior patterns of third-party payment,and limits the scope of third-party payment mainly discussed in the article.At the same time,it summarizes the criminal risks of third party payment generation,operation andtransaction links,and lays a foundation for understanding the causes of risks.The second part focuses on the major reasons for the increase of criminal risk under third-party payment.Firstly,it analyzes the illegal business risk of the link from the problem of risk control technology.Secondly,from the perspective of administrative supervision,it can not analyze the current laws and regulations.The paper analyzes the risk of the abuse of standby funds and the effective regulation of personal information security risks.Finally,it focuses on the analysis of several types of risks such as money laundering risk,cashing risk,theft and fraud risk in the transaction process from the perspective of criminal law system.It is about how to deal with the controversial issues after the crime has occurred,and also provides ideas for the subsequent regulation of such crimes,so that it has practical guiding significance.The third part first introduces the development status and supervision of third-party payment in other countries outside the region,and secondly summarizes some useful experiences that can be applied to China.Finally,it tries to reduce the technical innovation of the third-party platform from the source to reduce the risk.Some suggestions have been made on the administrative supervision and the improvement of criminal legislation and judicial activities.
