Research On Local Tobacco Control Legislation In China

The use of tobacco is a major obstacle to achieving sustainable development,with serious impacts on health,economy,society and the environment.Today,tobacco control has become a global trend.Since 1995,many localities in China have started special local legislation on tobacco control.After the approval of the WHO Framework Convention on Tobacco Control by the Standing Committee of the National People's Congress,new special local tobacco control legislation has been promulgated or revised.China has a vast territory,different political and cultural differences in various regions,and uneven economic development,resulting in different local tobacco control legislation from the level of effectiveness to specific regulations.As a public policy,the tobacco control policy aims to solve public problems and safeguard the public interest.However,China has not yet formed a state-level tobacco control legislation,and the current situation of tobacco control in China is still grim.This paper is divided into five parts.The first part of the thesis mainly expounds the background and research significance of local tobacco control legislation,and proposes that local legislation is prone to repeated legislation and operability is not strong.The second part of the thesis first introduces the brief contents of the WHO Framework Convention on Tobacco Control,and then introduces the current legislation on tobacco control in China.Through the statistics of local tobacco control legislation in various cities,the legislation for subsequent comparison is obtained.text.The third part of the thesis compares the main contents of the selected local tobacco control legislation texts from the aspects of legislative principles,no smoking areas,individual rights,operator rights and punishment standards,and draws the differences in local legislation.The fourth part of the thesis explores the problems and shortcomings of the current local tobacco control legislation,and makes recommendations for local tobacco control legislation.The fifth part of the thesis summarizes the analysis of the local tobacco control legislation,and draws the main aspects that affect the local tobacco control legislation and the national tobacco control legislation,and forecasts the national tobacco control legislation.
