Research On Tobacco Control Legislation In China

The harm of smoking to health is known to all,Smoking not only causes respiratory diseases,carcinogenesis,cardiovascular and cerebrovascular diseases,but also seriously pollutes the public space environment and indirectly endangers the health of others;In addition,the tobacco industry will also cause great waste to natural resources and cause serious pollution to the environment;And the negative social effects caused by tobacco will also impose a great burden on our society.Therefore,our country must charge tobacco control,and at present only legislation can achieve a good effect of tobacco control.Many countries or regions in the world have achieved good results in tobacco control through legislation,such as the United States,the European Union,Australia and Japan.However,our country's current tobacco control legislation is not perfect.After China's accession to the Framework Convention on Tobacco Control,there has been no legislation on tobacco control at the national level,which leads to the lack of a rigid legal basis for tobacco control in China.In our country,the legislation of local tobacco control is too old,which makes the local tobacco control standards in our country different and the quality is uneven;In addition,our country is still implementing the tobacco monopoly system of the integration of government and enterprise.All these are extremely unfavorable to the tobacco control work of our country.In this predicament,the tobacco control legislation of our country needs to be improved urgently,and should be perfected in all directions.First,in order to transform our tobacco monopoly system with government and enterprise integration,China's Tobacco Monopoly Bureau and China National Tobacco Corp must be completely separated,so that the Tobacco Monopoly Bureau can not only be an athlete but also a referee,so as to reduce the resistance of tobacco control in our country.Second,We should make full use of the advanced tobacco control legislation at home and abroad and the Framework Convention on tobacco control to formulate the tobacco control law,so as to provide a rigid legal basis for effective tobacco control in our country,and also set a standard for the formulation or revision of local tobacco control legislation;Third,reconstructing the tobacco control system of our country,raising tobacco tax appropriately,restricting tobacco advertisement in an all-round way,strictly reducing coke and reducing harm standard,making tobacco paperback system,tobacco sale system and big data monitoring system of tobacco industry and so on;Fourth,to perfect the system of smoking Prohibition in Public places and the delineation of Non-smoking places should be in line with international standards.In addition,it is necessary to make clear the subject of law enforcement and responsibility,to perfect the system of smoking control penalties and to put in place a system of declaring smoking prohibition;Fifth,establish relief system must be,to help smokers and provide timely relief to second-hand smoke exposure.
