Research On The Land Selling Contract Of Zhenyuan Gansu In Qing Dynasty

In ancient China,land was the most important and basic means of production and the people's place of life and shelter.It needs to be incredibly prudent to buy and sell land,often with written contracts.These land sales contract documents are the first-hand information to study land transfer in ancient society,which can reflect certain social reality.The author found a number of well-preserved and abundant land sales contract documents in Zhenyuan County in Qingyang Archives Bureau to study the following questions: Why did so many contract documents come into being in the process of land sales and transactions in Zhenyuan County in Qing Dynasty?What are the differences between these different formats of different types of contractual instruments? What are the characteristics of the constituent elements of a contract instrument?What kind of background does it reflect,and what can we learn from it as a reference to the modern rule of law in our country? With these questions,this paper has an analysis and research on the land sale contract of Zhenyuan County in Qing Dynasty.This thesis is divided into five parts.The first part is an introduction of the background and significance of the topic in detail.The second part briefly describes the ancient land sale contract system in China from two aspects: before Qing Dynasty and Qing Dynasty.The third part summarizes the types,specific formats,constituent elements of land sales contract documents in Zhenyuan County in the Qing Dynasty,and the characteristics displayed in the contract documents.The fourth part is the contemplation of the contract documents of land sale in Zhenyuan County in Qing Dynasty.At the very beginning,it summarizes the problems of the eras demonstrated in the contract of land sale in Zhenyuan County in Qing Dynasty,analyses the situation of further intensification of land annexation and the differences between the legal regulations and the actual practice in the land sale in Qing Dynasty.Finally,it discusses the inspiration of the contract of land sale in Zhenyuan County in Qing Dynasty for today on the basis of the principle of reality.
