The Legal Problems Caused By The High Bride Price In Hexi Area Of Gansu Province

In the 40 years of reform and opening up,earth-shaking changes have taken place in Chinese society,and profound changes have taken place in the main contradictions of our society in the new era.However,in this difficult period of reform and development,the bottle neck period of getting rid of poverty and tackling key problems has taken place.At the last moment of building a well-off society in an all-round way,there are still many social problems that have not been well restricted or effectively solved,especially the problem of high bride price in rural areas has been concerned by the academic community for a long time,and its social harmfulness has become more and more ferment.It has become one of the important problems to be solved urgently.The problem of high bride price in rural areas of Gansu Province is particularly serious,which has repeatedly become headlines and has been criticized by all walks of life.In the rural areas of Hexi area of Gansu Province,the peasants are also mired in the whirlpool of high bride price.Taking Gulang County,Gansu Province as an example,this paper makes an in-depth investigation of the local phenomenon of high bride price,makes an empirical study on the social harmfulness caused by the phenomenon of high bride price,and makes a normative analysis of the relevant legal problems caused by it.Then explore the real reason of its formation,in order to put forward reasonable countermeasures and suggestions for the management of the problem.The development of rural economy in Hexi area is slow,but the peasants are suffering from the problem of high bride price,and the high bride price is not onlyIt has serious social harmfulness,but also triggered a series of legal problems.This paper mainly sums up four legal problems,and discusses them with the support of interview cases.This paper holds that the legal problems caused by the high brideprice are as follows: the neglect of the relevant provisions of the Marriage Law;Induce domestic violence;violate the public order and good customs;disturb the social order.The serious phenomenon of high bride price makes people wonder whether this is a traditional custom or whether it is a serious violation of the relevant provisions of the Marriage Law.In addition,domestic violence,civil disputes and even vicious criminal cases caused by high bride price are notThe ban scares people,which not only seriously destroys the social atmosphere,but also affects the construction of socialist spiritual civilization,and its harm can be imagined.According to the author's investigation and excavation in the village,this paper finds out the deep reasons for the existence of the phenomenon of high bride price in rural areas of Hexi area,the loss of the cultural connotation of bride price and the thought of small farmers handed down from generation to generation,which makes the peasants only pay attention to the form of bride price.And ignore the emotional factors contained in it;The imbalance of gender ratio in intermarriage circle has led to serious "marriage squeeze",and the profit-seeking psychology of women of married age makes them more willing to move out of the countryside and move to urban or relatively more developed areas,which further aggravates the situation.In the "marriage squeeze" of poor rural areas,men of married age in rural areas have to pay high bride price to complete the marriage match task;The increase of individual differences among young men of married age has stimulated the profit-seeking nature of farmers and further contributed to the increase of the amount of bride price.The lack of governance mechanism makes the development of bride price more and more abnormal,deviating from the public order and good custom,and the phenomenon of high bride price is becoming more and more serious.It is imperative to curb the high bride price.The last part of this paper focuses on it.In accordance with the principle that the law is not omnipotent and the formal system and the informal system are coordinated and governed,this paper starts from four aspects: economy,culture,social strength and legal system.According to the deep causes of the high bride price in Hexi area,this paper puts forward some reasonable countermeasures and suggestions.
