The Study On Administrative Case-filing Register System

The transformation of China's filing system aims to effectively guarantee the parties 'legal right of action and supervise the court's filing work.At present,the filing registration system has greatly eased the difficulties in filing administrative cases,and the number of cases has increased.However,many cases are still ended in the form of "inadmissible" or "dismissal of prosecution" during the substantive trial stage,and often the parties abuse their rights of action.This also shows that the registration system has certain problems at the institutional design level.First of all,this system does not require the court to record its case by means of leaving traces throughout the process.This will cause the normative work of the court case to be weak and it is difficult for the parties to effectively supervise the work of the court.Secondly,the most obvious distinction between this system and the case review system is that only the formal elements are examined,but there are still certain substantive elements in the provisions related to the conditions of prosecution and the scope and criteria for the review of the conditions of prosecution are not clearly defined.The result is that the court still has a certain degree of autonomy in conducting the case review.This article will analyze the above problems in depth,and then put forward a more targeted optimization plan,so that the case registration system can play its due role more effectively.
