Research On The Registration System Of Administrative Litigation In China

The registration system established by the party in the fourth Plenary Session of the 18 th CPC Central Committee is an important measure for the judicial reform under the comprehensive deepening reform.Since the implementation of the registration system,the filing rate has increased significantly,especially in administrative litigation.This article tries to make a practical and theoretical analysis of the current administrative litigation registration system in our country,and use some foreign experience for reference,and it is of great significance to explore the way to perfect the registration system of administrative litigation in our country.The difficulty of filing a case in administrative litigation has not been solved,and the system of filing examination is an important factor leading to this problem.Registration registration system is different from filing examination system.They differ in filing conditions and contents.This paper collects and summarizes the number of cases on the first instance of the national court,the number of adjudication and the number of cases involved in the first instance,and collects the form of the chart,summarizes the positive effect of the registration system of the case,and analyses the problems arising from the related cases.The registration system on the one hand relieves the difficulty of filing a case and safeguards the litigant's right of action.But on the other hand,it also aggravated the contradiction between "fewer people in the case" and the abuse of litigation rights.It is worthwhile for us to learn from and learn from the real registration system in foreign countries and the registration of registered clerks.We can improve the registration system from the following aspects: first,improve the efficiency of the work and improve the service ability from the court;two,set up the sanctions mechanism for the abuse of the right to appeal;three,strengthen the supervision of the case,and promote thecomplete implementation of the registration system.
