Application of Administrative Law on Traffic Accidents in Transportation Enterprises is an unavoidable problem in the current society.It is generally believed that traffic accidents in transportation enterprises should be handled by the traffic management department in accordance with the Road Traffic Safety Law and its supporting administrative regulations.Those who hold this view ignore the particularity of the identity of the transportation enterprise.As a production and operation unit,the transportation enterprise must comply with the Road Traffic Safety Law and the Production Safety Law in its production and operation activities.Traffic accidents may violate the Road Traffic Safety Law and may also violate the Production Safety Law.This paper believes that traffic accidents occur in transportation enterprises.The accidents are handled by the traffic management department in accordance with the Road Traffic Safety Law and its supporting administrative regulations.If there is a violation of the provisions of the Production Safety Law,the safety supervision department shall apply the Production Safety Law.The law and its supporting administrative regulations deal with it,and there will be no conflict between the two laws.The transportation enterprise shall not conduct safety production education and training for the employees,and it is not related to traffic accidents.and the safety supervision department shall apply the administrative penalties to the first paragraph of Article 94 of the Production Safety Law.If a transportation enterprise has a production safety accident and is responsible for the accident,and there is a direct or indirect causal link between the illegal act and the accident,the safety supervision department may apply the administrative law to Article 109 of the Production Safety Law.
