Research On Labor Law Relationship Under The Background Of Internet Sharing Economy

In recent years,the form of employment in the context of Internet sharing economy has shown a rapid development trend.Compared with the traditional labor employment model,the employment mode in the economic sharing context is more flexible and diverse,and the definition of labor relations is more difficult.In judicial practice,there are also major differences in the issues concerning the identification of labor relations.Whether the new employment relationship under the economic form can be recognized as a labor relationship is included in the adjustment scope of the labor law,in addition to the relevant legal provisions,it should also be studied by type.This paper takes the online ride-hailing as an example.By analyzing the theoretical basis of labor relations in the context of Internet sharing and the investigation of the status quo of labor relations in China,it is concluded that the identification of labor relations lacks effective legislative rules and the standards of recognition are too rigid.Finally,it puts forward suggestions and opinions on perfecting the labor relations identification standard under the background of Internet sharing economy in China,and balances the relationship between economic innovation and the protection of the legitimate rights and interests of "laborers".The main contents of this article are as follows:The first part introduces the research background and research significance of the identification of labor legal relations under the background of Internet sharing economy,as well as the research status and main contents at home and abroad.The second part is an overview of the Internet sharing economy and a study on the issue of labor law identification in the context of Internet sharing.The third part is the comparison of labor and legal relations in the context of Internet sharing economy.It analyzes the characteristics of labor law relations between China and the United States under the background of Internet sharing economy,and provides enlightenment and reference for China to identify new labor law relations.The fourth part studies the type of labor legal relationship in the typical Internet car in the context of Internet sharing economy.According to the different types of online car,from the angle of the legal relationship between the express driver,the driver,the driver and the network car platform,the reasons for the frequent labor disputes and the theoretical disputes are found.The fifth part briefly describes the current problems in the labor legal relationship under the background of China's Internet sharing economy,and suggestions for improving these issues.
