The Legal Guarantee For The Benefits And Rights Of Workers In Production Safety

Security is a basic content of human rights protection,security and the implementation is one of the most important sign to measure the progress of social civilization,workers'safety and health is also a social management level to measure the human rights protection,economic development level and an important indicator of countries.Marx believes that only by working can humans get true liberation and human through working to embody the pursuit of freedom and consciousness,only when ability finds oneself value through working,and obtains the real development.A safe work environment can effectively reduce and prevent the occurrence of production accident and occupational disease hazards,so employers must create a safe work environment for workers to ensure life safety and health in the work process.Safe production is the premise and foundation of economic health development,which is an important guarantee of social stability.The production safety relates to the benefits and rights of the workers and the benign operation of the social economy.Production activities are the basis of human existence and development.As people's production activities expand and deepen,it is increasingly important to ensure the safety of the production process.The worker is the most important factor in the production activities,so the safety in production activities is closely related to the protection of workers' benefits and rights.In this paper,the author studies on production safety of the workers refers to the production department,production workshop and other departments are high-risk field of production accidents,and workers are at greater risk of production accidents.In order to realize the production safety and the benefits and rights of workers,we must build a good working environment,which must rely on the law as a strong guarantee.Since the founding of the People's Republic of China,the Communist Party of China(CPC)and the government have paid high attention to the guarantee of production safety and workers' benefits and rights.Since the 18th National Congress of the CPC,it has put forward new requirements for the production safety of enterprises.With the continuous development of the economy and the continuous improvement of the legal system,the production safety and the protection of workers'benefits and rights have been well established in China.The current situation of production safety in China is very complicated,and the occurrence of production accidents still bring a great threat to the health of workers.Production safety legislation,current of injury insurance system and production accident responsibility mechanism is also flawed,and the lack of effective supervision and management,make workers' rights suffered many illegal violation,which lead to the disharmony of labor relations,affect the normal operation of the enterprise and the economic efficiency,cause all kinds of social contradictions,and even bring the instability to society harmony.Rights and interests of workers suffered many illegal violation,leads to the disharmony of labor relations,affect the normal operation of the enterprise and economic benefits,easy to cause all kinds of social contradictions,and even threaten social harmony and stability.Therefore,it is necessary to promote production safety and effectively protecting the benefits and rights of workers on the four angles,judicature,respectively the legislation,law enforcement and law abiding.These are the need of workers' survival and development,and also the inevitable choice of healthy development of economic and harmony of social.
