Reserch On The Reform Of Judge Personnel System In Our Country

The reform of judge personnel system is an important decision put forward by the Third and Fourth Plenary Sessions of the Eighteenth Central Committee of the CPC.As the core step of personnel reform and the key measure of the construction of judges' ranks in the reform of judicial system,it has profound realistic background and long-term purpose.The basic contradictions in the judicial field and the changes in people's judicial appeals caused by the social transformation and economic development,as well as the the dilemma of the independent exercise of judicial power caused by the localization of the judiciary.These factors exert external pressure on the courts.The asymmetry between the overall quality of the judges and the judicial needs and the Administration of the Court's Internal Operating Mechanism lead to the internal pressure.The external and internal pressure forced the court to reform from top to bottom.Therefore,guided by Marxist theory and socialism with Chinese characteristics,the central government adheres to the principle of combining top-level design,scientific layout with pilot exploration and trial first.After three stages of slow proposal,comprehensive promotion and comprehensive supporting reform,it has set up "four beams and eight pillars" of the judge personnel system nationwide.At present,the reform has entered a "deep water period".Various reform measures and comprehensive supporting mechanisms have been gradually coordinated and unified and properly promoted.However,the lack of systematic theoretical guidance and scientific legislative planning in the process of reform also deserves our attention.The unscientific design of the selection mechanism of judges,the vague management mechanism of adjudicators,and the inefficiency of reform measures lead to different evaluation of reform.Therefore,on the basis of combing the background,purpose,theoretical basis,promotion process,concrete measures and results of the reform of the judge posting system in China,this paper wishes to point out the outstanding practical and detailed problems in the process of the reform of the judge posting system,and put forward some suggestions to solve the above problems in the process of further deepening the reform,with a view to providing some reference for the promotion of the reform of the judge posting system in China.
