Our country is now in full swing for judicial reform, which involves the implementation of the personnel system of judges.We need to implement the personnel system of judges in order to realize the professionalization,specialization,elitism of judge, and to improve the trial efficiency and quality of case.The basic level court is the main force in the case of the court in our country.And The reform of the personnel system of judges in the basic level courts directly determines the success or failure of the judges in the country.Therefore, it is necessary to investigate and study the reform of the personnel system of judges in the basic level court.This paper is composed of the introduction, the main body and the conclusion.And the main body consists of four parts.Part I describes the overview of the judge personnel system.First,i defines the meaning of the judge personnel system.The judge personnel system, is a system of centralized exercise judicial authority of the state,which refers to in the compilation of the court according to the number of certain standard is relatively fixed judge, in accordance with the professionalization of judges to the requirements of the truly meet the professional judge conditions of judges determined as a judge of judges who rated series later.Secondly, i discusses the significance of the implementation of the judge personnel system in our country.As far as our country is concerned, there are at least three aspects of the theory and practical significance of the implementation of the judge personnel system:Firstly, the judge personnel system is the cornerstone of the professionalization and the elite of judge;Secondly,the judge personnel system is conducive to improving the quality of judge and strengthen professional security;Thirdly,the judge personnel system is conducive to improving the quality and efficiency of the trial case.Part II is the introduction of the pilot reform of the of judge personnel system in the basic level court.Firstly,i sorted the origin and development course of the judge personnel system in our country.The whole process includes three stage: the exploration stage, development stage and the determination stage.After that, i selected Shanghai City, Guangdong Province and Hainan Province as the research object to introduce the basic situation of the reform of the judge personnel system. Finally,according to the polit situation of the judge personnel system of the level court in ourcountry,i made an overall evaluation, including the achievements and prominent problems.Part III disgusses some deep-seated problems and difficulties which the judge personnel system of the basic level court in our country will face in the future. First of all, the implementation of the judge personnel system in the basic level court has a great reform resistance which mainly comes from the leading of the court and the new and old judge.Secondly, our country judge professional and judicial power runs to serious administration, especially the basic level court,which maybe produce a certain obstacle to the implement reform of judge personnel system in the basic level court even in all the courts in our country in the future.Thirdly,as far as the whole grassroots team of judges are concerned,it's difficult to fully select out excellent judge when we implement the judge personnel system at the reforming transitional stage.Finally, for a long time, our country is not perfect for the construction of the guarantee system of the judge group.Due to the construction of the system of the judge's protection is not perfect, there are some judges fell discontented for their hard work and low incomes which lead to the "judge resign wave" phenomenon in a short period of time.After implementing the judge personnel system,if we don't consummate the system construction in this area, it will be difficult to implement the judge personnel system and unable to play its due role.Part IV explores the improvement measures of the judge personnel system in the basic level court.In view of the current judge personnel system in court trial highlights the problems and that may be encountered the deep-seated difficulties in the future,i suggests we could consummate it from four aspects when we consummate the judge personnel system in the basic level court.First of all, we should get the judges personnel determined which should pay attention to some factors and choose the right way as well.,Secondly,we need to consummate the selection of judge which we should pay attention to three aspects:the selection requirements of the personnel judge of candidate,the mode of selection of the personnel judge and the fairness of the selection procedure of the personnel judge..In addition, for the special period of the reform of the transition,we should properly handle the issue of the judge of leadership and try to add non-personnel judge in order to successfully complete the transition work.Finally, we need to pay attention to the implementation of the corresponding measures when carrying out the reform of the system of the judges in the basic level court.which we should strengthen and improve the equipmentwork of the judgeassistant for the judges in the trial, improve appropriately the running mechanism of the judicial power in our country at present and strengthen the judge's professional security system.
