Research On The Collective Land Requisition System Reformation Based On The Evaluation Of Implementation Performance

With the acceleration of our country's modern urbanization and industrialization process,the demand of construction land is gradually increased,a large number of new construction land entering the market mainly through land requisition that turns the rural collective-owned land into state-owned land;at the same time,the long-term development of market economy makes the farmers' cognition of property rights and legalization stronger,the current system of land requisition does not meet the need of social development,problems gradually emerge.By deep analysis of the presentation and reasons of the problems,and from the performance of land requisition implementation to improve the current land requisition system,it's beneficial to effectively insure the national demand for construction land,and can better protect the fundamental interests of the farmers,it is of great significance.In this article,the author reviews the historical development of land requisition system in China and the relevant research about the implementation of land requisition Then selecting three typical cases:the examination and approval authority issues at Kebei Residents' committees in Qixian Street,the question of land requisition procedure and the compensation allocation at Wuyang Community in Fuquan Street,the question of land use legitimacy in Xialv Town and Wangtan Town,the author summarizes the main problems existing in the current policy in the process of land requisition,for example:the interests of landless peasants are affected due to incomplete program in detail;the performing of land requisition procedure become a mere formality,just the pursuit of the announcement,it's not timely responsed by the landless peasants;landless peasants in previous are not fully involved in land requisition compensation negotiation,just with rare opportunity to participate in and express their own views;the distribution scheme of land requisition compensation is mainly set by the rural collective,lacks of a reasonable and effective allocation and management mechanism;settlement way is relatively single;scattered land caused by land requisition doesn't have reasonable compensation scheme which makes the landless peasants interests damaged.On the basis of above,the author conducts a questionnaire survey about the most focused problems oriented to the town(street)staff,village cadres and landless peasants,mainly from three aspects of land requisition procedures,land requisition compensation and relocation.Based on the questionnaire results of classification statistics,the author finds that the main contradiction at this stage existing in land requisition procedures is without effective two-way communication,at the early stage of the land requisition without communication and illustrating about the compensation and resettlement standards and system.Finally,in order to improve land requisition performance,strengthen the supervision of land requisition,this article builds a system of land requisition implementation performance evaluation system from reasonable planning,reasonable procedure and two-way in place,reasonable compensation standard,compensation payment distribution and appropriation,and suitable settlement for landless peasants.The author also puts forward the corresponding policy recommendations from two-way program of land requisition procedure,compensation before approval,compensation standard being measured and updated timely,improving compensation allocation mechanism,expanding the scope of the compensation to solve sporadic land caused by land requisition,improving the system of the landless peasants employment,broadening the landless peasants' resettlement way,perfecting the judicial relief system and so on.
