The vigorous development of the third party payment industry has brought about the innovation of the payment method.It not only spawned a new era of online shopping,but also the application platform of the three party payment platform,such as Alipay and We Chat,has been continuously enriched,and has become a functional composite platform,which has become a private custom-made "bookkeeping" for consumers.It keeps a detailed record of consumers' basic information and consumption trajectory.As a result,the problem of personal information security also arises.The law of the people's Republic of China on the protection of consumers' rights and interests,the law of network security and other laws only stipulate the collection and use of personal information in principle,but do not establish a perfect personal protection system.Especially when the personal information of consumers is leaked and the derivative infringement is caused,the law of our country lacks the corresponding relief rules,so the legitimate rights and interests of consumers are difficult to be protected.Therefore,it is necessary to strengthen the protection of consumer personal information and build a complete information protection system.This paper focuses on the information security problems caused by consumers' online and offline consumption using the third-party payment methods,and focuses on typical cases.The structure of the article is as follows:In the first part,four typical cases are cited to summarize the three issues that need to be paid attention to in the protection of consumer personal information in the third-party payment: the consumer rights and interests protection law of China does not clearly stipulate the concept and scope of consumer personal information;the rules for the collection and use of consumer personal information by the third-party payment enterprises need to be further improved;the consumer individual in the third-party payment There are various types of information infringement,which need to be comprehensively managed.The second part discusses the category of consumer personal information and related rights in the third-party payment.Combined with the definition of personal information inside and outside the domain,we can understand the meaning of personal information of consumers by means of identification standards andenumeration;comprehensively summarize the content of personal information of consumers in the third-party payment,including basic identity information,password verification information,consumption information,security management information,and distinguish it from general personal information in information sensitivity,capacity and business value;the same as at the same time,consumers have the right to decide,inquire,delete and keep their personal information confidential.The third part of the third party payment for how to collect,use consumer personal information to make recommendations.At the level of collection,it is necessary to make clear the subject,principle and scope of collection;at the level of use,it is necessary to make clear the type of use of information,effectively control the scope of authorization and set the reasonable use of information.The fourth part aims at the problem of consumer's personal information infringement in the third-party payment,and needs to strengthen comprehensive governance.At the level of responsibility subject,it is necessary to set up a special personal information protection department,a personal information protection association of the third-party payment industry and a third-party payment enterprise to strengthen the self-discipline awareness of the industry;at the level of system,it is necessary to add sensitive information protection system,information anonymity system,risk management system and information disclosure report system into the personal information protection legislation;at the level of information In the system of liability and relief,we need to punish the large-scale personal information disclosure of enterprises,severely punish the criminal behavior of infringing personal information of citizens,and improve the civil relief system of personal information infringement.With the change of payment means and consumption mode,the exposure rate of personal information increases,and the risk of non difference and cross region leakage also rises abruptly.The legislation of personal information protection in China must pay attention to the information security of consumers,so as to realize the comprehensive protection of consumers' legitimate rights and interests.
