The working hour system is an important part of the labor standard.A perfect working hour system is conducive to regulating the employment behavior of the employer,so as to protect the legitimate rights and interests of workers.In the past 20 years,China's working hour system has played an important role in China's economic development and social stability.However,the current working hour system is difficult to adapt to the increasingly developing society.The outbreak of"996" working hour system event is a prominent performance.There are four main problems in the current working hours system:first,the definition of working hours is not clear;second,the standard working hours system in China has not yet formed a unified standard;third,the problems in the special working hours system in China,which are embodied in the application scope is too general,the workers' right to rest is difficult to be guaranteed,the lack of prior consultation and post supervision;fourth,the extension of work in China There are some deficiencies in the time system,including slightly harsh upper limit provisions,unreasonable provisions of relevant punishment measures and poor law enforcement by the labor supervision department.In order to protect the legitimate rights and interests of all aspects of workers and prevent employers from further squeezing workers,China's current working hour system has to be modified.First of all,we should not only define the limits of working hours and establish a unified standard working hour system,but also perfect the special working hour system in China,refine its applicable provisions,guarantee the workers' right to rest under the special working hour system,and implement prior consultation and post supervision.At the same time,for the extended working hours system,we should appropriately relax the control of its upper limit provisions and reasonably stipulate relevant penalties measures and strengthen the law enforcement of labor supervision department.
