With the rapid development of the economy,people's material quality of life has greatly improved,people began to pay attention to their own quality of life,the pursuit of more leisure time;as part of the industry work greatly affected by the season,seasonal impact,often need to focus on operations,And focus on rest;In addition,due to the rapid development of services,finance and other tertiary industries,as early as nine to five working hours model has been unable to meet the needs of China's production enterprises.In this case,flexible working hours system came into being.Flexible working hours system not only meet the actual needs of the labor force,but also to respect the personal rights of employees;not only to make employees more flexible to deal with personal life and work relationships,but also help to improve job satisfaction and efficiency.People are increasingly accustomed to the flexible working hours system,the news of the reform of the business hours are also common newspapers,especially multinational companies have the courage to break through the existing system continue to try various forms of flexible working hours system.However,there is no definite definition of flexible working hour system in practice or judicial practice,and there is no stipulation of flexible legal system in the implementation of flexible working system,lacks legal restraint.In China,on the one hand,the people are eager to implement the flexible working time system,and on the other hand,some enterprises,by the name of the flexible working hours,require workers to work overtime and do not pay overtime wages and frequently violate the rights and interests of laborers happens sometimes.The unavoidable reality is the lack of legislation in China's flexible working hours system,the lack of a clear definition of the scope of application of flexible working hours,the lack of a clear definition of approval procedures,and the existence of frequent labor administrative disputes.Working time is a core element in labor relations,the appropriate working time system is the common pursuit of both employers and employees.Flexible working hours system is the product of the development of working hours to meet the needs of both employers and employees.However,due to the lack of working time legislation,flexible working hours system in the course of implementation challenges,resulting in violations of the rights and interests of workers.Based on the experience of flexible working system in developed countries and regions,this paper analyzes the causes of flexible working hours system in China,and provides some suggestions and suggestions for the future development of flexible working hours system in our country through the methods of literature analysis and comparative analysis.This paper is divided into three parts,focusing on the central issue of the flexible working hours system.The first chapter is the first part,the introduction part mainly combines the domestic and foreign literature to carry on the theory summary,and leads to the research question.The second part includes the second chapter and the third chapter,the second chapter mainly defines two important concpts of the flexible working system in our country.Chapter 3 gives a theoretical analysis of the current situation of China's flexible working hours system,and takes Shenzhen as an example to analyze the current situation of flexible working system in China,reveals its legal problems.The fourth chapter is the third part,respectively,introduced the Japanese flexible working hours of the relevant legislation and implementation of the status quo;flexible working hours system in Germany the origin and development of flexible working hours in Taiwan,China's current legislation related to the status quo.The fourth part is the fifth chapter of this article,summarize and summarize the elaboration of this article,and offer the opinion and suggestion to the flexible working hour system legislation of our country.
