Research On The Legal Guarantee Around The Quality Supervision Of EIA Document

Environmental impact assessment document as a predictive assessment of the impact of construction,expansion and reconstruction projects on the environment,it's becoming more and more important for environmental protection.The scientific and fair of the environmental impact assessment document has become an important goal for the other relevant departments,stakeholders and beneficiaries.However,the false data have occurred in the environmental impact assessment document.The neutrality requires environmental impact assessment technical unit excludes non-exclusive facts and itself in dependence from the entrusting party and approving authority.If the environmental impact assessment technical unit lose neutrality in the process of environmental impact assessment,the environmental impact assessment document will be biased and lose the impartiality and credibility.The environmental impact assessment document is difficult to convince the public around the project and approval authority to believe and adopt the document.The results of the environmental impact assessment document can be corrected through administrative or legal proceedings,but environmental pollution is difficult to control.Therefore,for the purpose of promoting the effectiveness of the environmental impact assessment document to elaborate the current situation,to analyze legislative and judicial defects and improve the proposal.This paper is divided into four chapters:The first chapter is an overview,mainly discusses the basic concept of environmental impact assessment document and environmental impact assessment institution.The second chapter is about current situation.The third chapter mainly explores the legal problems and analyzes the reasons.The fourth chapter is about the improvement of legal system.From an innovative perspective,to research environmental impact assessment institution around quality supervision of environmental impact assessment document.This is not only the need of the environmental impact assessment institution,but also the demand of administrative organs,construction units and the public.Based on the situation,analyze the legal framework for quality management of environmental impact assessment document.But it needs to be improved.The regulation of legislation from the following aspects:The first,encourage the unit to adopt the form of flexible operation partnership.Give full play to environmental impact assessment technical unit's professional advantages.The second,to clean the form of public participation and expands the channel for the quality supervision of environmental impact assessment document.The third,to strength the in-event and after-event supervision of approval department through detailed technical evaluation and build the norm of the technical review.The fourth,to leave room for public opinion through introduce alternative solution.The supervision of approval department should focus on the environmental impact assessment document.In the judicial practice,the court strengthened its interpretation on the professionalism of the environmental impact assessment document.
