Study On Japanese Seafarers' Occupational Security Law

The development of marine economy is an important growth point of national economy.All countries are actively developing marine economy.China is not only a land power,but also a sea power,with broad strategic interests in the sea.At present,Chinese marine industry in general has entered the best period of development in history.With the development of shipping industry,as the country with the most abundant human resources,China attaches great importance to the development of seafarers.China has become one of the countries with the largest number of seafarers members in the world,accounting for about one third of the total number of seafarers members in the world.General secretary Xi Jinping has repeatedly stressed the importance of building a strong maritime country.The realization of the dream of a strong maritime country cannot be achieved without the seafarers who are dedicated to the sea.Seafarers are a special professional group.They work at sea all the year round.They are under great pressure both physically and mentally.The guarantee of the state and law is an important condition for their professional stability.Unemployment is a global problem,which is likely to be fatal for the seafarer.In the short term,it is difficult to maintain the source of life only by relying on oneself to find satisfied shipowners and shipping companies.At this time,if there is the intervention and guarantee of the state power,the seafarer will get great psychological motivation,and will also actively participate in employment,so as to ensure the sufficiency of the national marine labor force.Japanese seafarers' occupational security law is a law that the author pays more attention to.The reason is that there is not a complete law on job selection and employment security for seafarers in China.Japanese seafarers' occupational security law came out earlier,experienced a historical test,and kept pace with the times.After that,the implementation rules and supporting laws and regulations of seafarers'occupational security law were issued,further improving the employment security system of seafarers,which is of great benefit to stabilizing the seafarers' market.Therefore,the author would like to make some contribution to promote the legislation through the study of this law,combined with China's current deficiencies in the legislation of seafarers occupation.The author makes use of the method of literal meaning analysis,consulting materials and books,collecting documents related to the law of seafarer's occupational security,and analyzing the connotation and contents of the law of seafarer's occupational security.The main concepts of this law are explained and defined,and the important value of this law to the employment of Japanese seafarers is studied.After the above contents are clarified,the author compares the legal system of Chinese seafarers'occupational security,draws on the beneficial aspects of Japanese law on seafarers'occupational security,and speeds up the special legislation and system construction of Chinese seafarers' law.This paper is divided into five chapters.The first chapter combs the basic concepts involved in the seafarers' occupational security law,mainly the concepts of the seafarers'and the occupational security law,briefs the legislative process and development of this law,analyzes the departmental attribute and legislative mode of this law,and draws useful legislative experience from it.The second chapter makes a detailed statement of the main contents of this law,especially focusing on Japanese seafarer career introduction system and seafarer career guidance.The third chapter analyzes the characteristics of the seafarers' occupational security law,mainly from the aspects of legislative technology and main content.The fourth chapter reflects on the deficiencies in the employment security of seafarers in order to promote timely legislation.The author puts forward some legislative suggestions on the employment security of seafarers through the study of seafarers' occupational security law and the combination of China's specific national conditions.
