The Improvement Of Government Procurement Law Under The Framework Of WTO Agreement On Government Procurement

China became an observer of GPA when joining the WTO in 2001.Then China started the negotiation of joining the GPA in December 2007.By December 2019,China has submitted seven lists to the WTO and the seventh list whose scope expanded further has been equal to the other member of the GPA.China shows the determination and sincerity to join the GPA and the confidence to open the government procurement market to the outside world.Joining the GPA just as joining the WTO,the party should amend laws to ensure the domestic laws are consist with the GPA.China has formed a legal system for government procurement,which also plays an important role for the operation of the market.But on the one hand,the domestic legal system is deficient,on the other hand,there are many differences between domestic laws and the GPA.So it is important to learn relevant experience to improve domestic laws from the GPA,from the members of the GPA and the other international organization.In order to analyse the new trend of international government procurement rules and compare the differences between the domestic Government Procurement Law and the GPA,the paper discuss from the perspective of the GPA and on the basis of the current legal system of government procurement in China.Then the paper make suggestions on the improvement of electronic government procurement,the methods and procedures of government procurement for joining the GPA.Although China has not yet joined the GPA,but the topic of government procurement has been referred in the negotiation of the FTA.The FTA between China and Korea and the TFA between China and Australia have made corresponding arrangements on government procurement.It can be predicted that once China joins the GPA,domestic laws will be amended and more bilateral,multilateral or regional negotiations will also refer to government procurement.So the improvement on China domestic laws will have an important impact on the development of government procurement trade at home and abroad in the future.It hopes that the suggestions in this paper can make a little contribution to the improvement of the Government Procurement Law for Chinajoining to the GPA.
