| Protecting the legitimate rights and interests of minors and paying attention to the healthy growth of minors are essential tasks for the sustainable development of a country.The protection of minors is a systematic project that covers all aspects,such as judicial protection,social protection,school protection and family protection.Providing legal aid for criminal minors is a critical part of judicial protection.It reflects the protection for the human rights which have been regard ed as constitutional right to the minor criminal suspects and defendants,and demonstrates judicial caring in assisting criminal minors.With the progress of the information society,juvenile delinquency has shown some new characteristics such as younger,more violent,high frequency,and involves various types of crime,some historical problems that have always existed in juvenile criminal legal aid work are also escalating at the same time.Criminal legal aid for minors is an indispensable part of Chinese legal aid project,and it is a significant business card to show the judicial civilization of our country.Its development and improvement are of great importance to enhance judicial authority.The article firstly from three perspectives as definition,characteristics,and value to give a overview of the criminal legal aid system for juvenile delinquency.Criminal legal aid for minors as a branch of the legal aid system in China.The legal aid system is designed to provide legal assistance to people in financial difficulties and weak,which is a critical means to help the poor to protect and improve people's livelihood.Secondly,the article introduces the criminal legal aid systems in Anglo-American law system and civil law system countries and shows their representative legal aid system models,the uniqueness of the design of the criminal legal aid system for minors is included.Contrast with the current system in China,summarize and think about it,and offer experience for improving Chinese juvenile criminal legal aid system.Thirdly,the article introduces the main problems in the practice of juvenile criminal legal aid in China;such as the aid legislation is not perfect,legal aid is not comprehensive,insufficient guarantees for criminal legal aid funding and poor quality.Finally,based on the foregoing,a research model of problem discovery-analysis problem-solving is used to address the main problems of juvenile criminal legal aid,and to make recommendations from those aspects of legislation,full assistance,funding guarantee,and quality supervision. |
