Study On The Guardianship System Of Left-behind Children In Countryside

Left-behind children is a outstanding phenomenon in current society,we always find the tragic events endless emerged during left-behind children.These things brought irreparable damage to many families that rural left-behind children are mostly could not take care by their parents.Left-behind children's parents in order to improve the living standards of family,they have to separates with their children so long-term.This problem is an urgent that it needs to establish a new system to create a good atmosphere of these family to care of their children and protect their legitimate rights.This paper is based on this problem to research from the view of the law of left-behind children custody.It used literature analysis methods,social investigation and other methods to discuss the current rural left-behind children's monitoring situation.This paper has divided into three parts:the first part is an overview of left-behind children,it's including definition of left-behind children and monitoring left-behind children.In the second part,it's discuss the current situation of left-behind children's guardianship.Our country's law have not formed a complete system to protect left-behind children,which made the rural left-behind children's guardianship comes out many problems.It's mainly reflected on the limitation of rural left-behind children guardianship legislation idea and the shortcoming of rural left-behind children guardianship legislative system.General Principles of civil Law,the Law on the Protection of Minors,The State Council approved in principle about left-behind children and so many other regulations for children's right,but there are still have some problems on the legislation ideas.The third part mainly proposes some suggestion to perfect the left-behind children guardianship system.The perfection of rural left-behind children legislative system need to revise the legislation.It has to clear parental right and guardianship,clear guardian relationship how to cancel and change,clear ideological problems such as cancel and change guardian relationship and clear the sequence of guardians.At the same time,this paper will perfect rural left-behind children guardianship system from perfect rural left-behind children legislative system,diversification of guardianship pattern and entrust system.
