The Text-Study On Laws And Regulations Of Chinese Children's Rights Protection Based On The Content Analysis Method

Children are the future and hope of the whole country and nation.Whether events that children's rights have been impaired in recent years it is often seen,or"China's Children Development Program(2011-2020)" and "China's Young Pioneers Reform Program(2017)" and other policies issued,or the new goal of children's rights protection formed in the new era,will show that it is significant to children's rights protection for themselves healthy development.In this paper,Content Analysis is used to study relevant laws and regulations on children's rights protection in four decades of reform and opening.Meanwhile,the purpose is analyzing the provisions and existing problems of laws and regulations related to children's rights protection since reform and opening up,and putting forward corresponding suggestions and countermeasures to further improve the laws and regulations on children's rights protection in the new era,thereby promoting the healthy development of children's rights protection in China.According to general steps of Content Analysis.The first,putting forward research problems of the study,to analyze the provisions of relevant laws and regulations on children's rights protection since reform and opening up,to put forward corresponding suggestions and countermeasures to perfect the laws and regulations on rights protection of new age's children.The second,selection scope of research samples is determined as current effective laws and regulations on children's rights among 1978 and 2019.The third,the theoretical analysis framework of laws and regulations on children's rights is constructed based on both the corresponding relationship theory of "rights and obligations" and the connotation of legal protection of children's rights.The fourth,according to the theoretical analysis framework of laws and regulations on children's rights,encoding the relevant laws and regulations,and counting the frequency of encoded information,then the relevant results are analyzed quantitatively by using statistical analysis methods,whose data processing results are displayed intuitively by charts and other forms.The fifth,analyzing and explaining data processing results is to find out types of coding data and the internal logical relationship.Based on this,summarizing and analyzing the provisions and existing problems of laws and regulations on children's rights protection since reform and opening up.The Sixth,according to provisions and existing problems of laws and regulations on children's rights protection since reform and opening up,putting forward corresponding suggestions and countermeasures for the improvement of laws and regulations on children's rights protection in combination with objectives of the rights protection in the new era.Since reform and opening up,Chinese laws and regulations and its existing problems on children's rights protection are as follows.Firstly,although Chinese legal system of children's rights protection has been improving,a large number of laws and regulations have been formulated in short time,and the quality of laws and regulations is difficult to guarantee,even there are few specialized legislations for children's rights protection.Secondly,the subject dimension of laws and regulations includes a wide range of issuers,a high level of power institutions,and a wide range of protected groups of children;the existing problems contain the subject of "each department acting on its own",no special authority department for children's protection,no high and no enough quantity in the special legislative rank for children's rights protection of vulnerable groups,not fully cover all groups and all rights in vulnerable groups of children and so on.Thirdly,specific children rights dimensions contain more and more content of children's rights protection,children's rights protection changed from survival rights to development rights,but Children's Participating Rights still need attention.Fourthly,the legal liability dimension covers the problems of imperfect legal liability provisions,weak operability and effectiveness,the phenomenon of "emphasizing administrative liability rather than civil liability",so there are also some problems to be discussed on the criminal responsibilities.Putting forward improvement proposals and countermeasures in terms of laws and regulations related to rights protection of new age's children mainly includes:the first is to improve legislative procedures and mechanisms to promote the high-quality development of legislation;the second is to strengthen the special legislation for children's rights protection;the third is to strengthen the relevant legislation for children's rights protection of vulnerable groups;the fourth is to strengthen legislation of children's rights protection in key areas;the fifth is to standardize and improve relevant legal liability provisions for children's rights protection.
