Research On The Legal Protection Mechanism Of Children's Rights

Children belong to vulnerable groups because of their special psychological and physiological characteristics.Children are vulnerable to be victims of violations and attacks,so more and more people realize the importance of child rights protection.In today's increasingly complex social relations,the protection of children's rights has fallen into multiple dilemmas.There are inadequacies in the legislation for the protection of children's rights,as well as defects in the operation of the protection of children's rights.Therefore,the international community is required to recognize the subjectivity of children in accordance with international law while safeguarding their basic rights,and the laws of various countries are required to provide special protection for children.Perfecting the law to protect children's rights and dealing with the protection of children's rights are the basis for the healthy and happy growth of children,and the necessary condition for the process of legalization in China.This paper consists of four parts:The first part is "overview of the protection of children's rights",which specifically analyzes the basic theory of the protection of children's rights.Firstly,the concept of children and the basic meaning of children's rights are analyzed.Secondly,it analyzes the specific content of children's rights and the four basic principles of protecting children's rights,namely the principle of children's best interests,the principle of non-discrimination,the principle of children's survival and development and the principle of children's participation.The second part is "the basis of international law for the protection of children's rights",introducing the relevant international conventions on the protection of the rights of the child,including general conventions and special conventions on the protection of the rights of the child.At the same time,it introduces the situation of China's accession to the above-mentioned convention and its concrete implementation.The third part is "foreign legal protection mechanism of children's rights",which briefly analyzes the legal protection mechanism of children's rights in three representative countries,including the United States,the United Kingdom and Japan,in attempt to provide reference for the relevant legislation on the protection of children's rights in China through comparative research.The fourth part is "the problems and improvement of the protection mechanism of children's rights in China",mainly elaborates the problems in the protection mechanism of children's rights in China,and puts forward the corresponding countermeasures,that is,improve the legislative system of children's rights protection,improve the judicial system of children's rights protection,and improve the administrative measures of children's rights protection.
