The consular protection of a country is subject to multiple restrictions by international law,multilateral and bilateral treaties,the laws of the host country and domestic laws.The major developed countries in the world have clearly defined the scope of “consular protection” that are permitted,so have China.Whether domestic or abroad,violations of laws and regulations necessarily result in repercussions.It is not uncommon for Chinese citizens to violate laws in Africa.Specifically,circumstances in Africa make it so that the offenders' behaviors will not only bring greater security risks to themselves,but also affect the overall image of Chinese citizens and the Chinese state,worsening the Chinese-African business environment,leading to vicious cycles of deteriorating relations.How to carry out consular protection for the illegal actions of Chinese citizens in Africa has become a difficult problem that Chinese embassies and consulates have to face and deal with.As Chinese consular protection becomes more mature and rational,Chinese embassies and consulates abroad are paying more and more attention to the limited nature of consular protection.In the face of violations of laws and regulations,embassies and consulates adhere to a clear policy stance,one which protects the legitimate rights of Chinese citizens in Africa without intervening in the warranted punishments for unlawful behaviors and violations of foreign state's laws.Embassies focus their efforts on specific groups of likely offenders,carrying out various forms of prevention and education,promptly updating laws and regulations and creating a more convenient investment environment from the perspective of Chinese citizens in Africa,to reduce the business costs of law-abiding Chinese businessmen.It can be said that for Chinese in African,consular protection and the preventive measures for citizens violating the law employed by the embassies have achieved remarkable results.However,faced with such challenges as the dynamics of cultural brotherhood and nature of Chinese interpersonal relations,the unrealistic expectations of offenders and the diplomatic liabilities of the government,imperfect domestic laws,and the limited reach of the government's messaging campaigns,it is still quite clearly a complicated systematic project to offer adequate consular protection for offending Chinese citizens in Africa.It requires long-term policy implementation,and comprehensive prevention and control.This paper deals with the following recommendations: crafting effective consular protection legislation,establishing a personal or collective credit rating and recognition system,encouraging market-oriented provision of legal compliance training courses,a larger role for non-governmental organizations,an emphasis on person-to-person mutual assistance and a lesser reliance on government intervention in these matters.Finally,the introduction of more efficient and innovative public messaging campaigns,such as developing new forms of media and outreach,and publicly exposing negative cases on these new platforms.
