| The level of development of bankruptcy system is an important reference to measure the level of social and economic development,while the object of application of the current bankruptcy legal system in China is limited to corporate legal person,not including illegal organization and natural person.The establishment of personal bankruptcy system will improve the bankruptcy system of our country and provide a "package" solution to many current social contradictions.For the establishment of personal bankruptcy system or not,academic circles have been arguing constantly.This paper focuses on the current situation of our society and the actual needs of social development,from the theoretical combing of personal bankruptcy to the analysis of legislative conditions,and combined with Wenzhou "personal bankruptcy case",puts forward some thoughts on the construction of personal bankruptcy system,and boldly puts forward some ideas about personal bankruptcy system.This paper is divided into four parts:The first part is the introduction.This part mainly introduces the background,significance,current situation and research methods of this paper.The second part is the basic theory of personal bankruptcy system.This part mainly combs the theory of personal bankruptcy system,and makes clear the concept of relevant theories.The third part,the necessity and feasibility analysis of constructing personal bankruptcy system in China.This part mainly analyzes the necessity and feasibility of building personal bankruptcy system in China from different perspectives,and then discusses the realistic basis and demand of building personal bankruptcy system in China.The fourth part,the construction of our personal bankruptcy system.This part is mainly through the thinking of the above problems,combined with the actual situation of our country,put forward the thinking of building our personal bankruptcy system,and boldly imagine that building personal bankruptcy system is a solution to some special problems. |
