Research On The Non-litigation Settlement Mechanism Of Social Insurance Disputes

Social Insurance is an important social security system of the country.The disputes arising from social insurance can be divided into administrative disputes and civil disputes.Compared with litigation,alternative dispute resolution has the unique advantages of non-confrontation,flexibility and low cost in resolving conflicts and repairing social relations.However,at present,there are many problems and disadvantageous factors in the construction,development and utilization of the non-litigation procedure of social insurance in China,such as imperfect legislation,scattered dispute settlement approaches,and non-unity of various functional departments,non-litigation settlement of social insurance disputes.Compared with foreign countries,Germany,where the social security system started early,has a special social court,the United Kingdom also has a special advisory,mediation and arbitration services.The United States,on the other hand,encourages and develops informal mediation.Therefore,based on the current situation of our country and the historical experience of foreign countries,this paper proposes to further clarify the nature of social insurance disputes and improve the legislation of non-litigation of social insurance disputes,taking the non-litigation dispute resolution mechanism as a necessary pre-procedure,further improving the docking mechanism betweenlitigation and non-litigation,making use of the advantages of the Internet to realize cloud management,and actively building an online multi-mediation platform,to solve the problem of social insurance in the form of non-litigation.
