Study On The Difficulties And Countermeasures Of The Implementation Of The Food Safety Law In N County S Town

It has been more than ten years since the Food Safety Law was promulgated and implemented in 2009.During this period,it was revised twice in 2015 and 2018.The revision in 2015 was based on the situation of China's food safety,and its purpose was to enrich and improve the Food Safety Law.It was increased from 104 articles to 154 articles,and 70% of them was substantially modified.The revision in 2018 was based on the changes of regulators involved in the institutional reform of the State Council,and no new clauses was added to it.The revision of the Food Safety Law is of great significance to ensure food safety,promote the healthy development of the food industry,and strengthen the construction of China's food safety regulatory capacity.It fully demonstrates the determination of the state to establish the strictest food safety supervision system.The Food Safety Law is the most widely used law in the field of food safety supervision.By strengthening punishment and raising standard requirements,the production and operation behaviors of food business households are effectively standardized,and the food safety of the public is guaranteed.But at the same time,the Food Safety Law also encountered many difficulties in the implementation process.Especially in the process of primary supervision,the problem is more significant.This paper takes the implementation of the Food Safety Law in N County S Town as the research object,and sorts out its dilemma in the supervision process of N County S Town.Finally,the reasons are analyzed and countermeasures are put forward.This paper mainly includes six parts: The first chapter is "Introduction",which mainly introduces the background and significance of the thesis,summarizes the research status at home and abroad,launches the research contents and methods,explains the theoretical basis of the thesis,and states the innovation and shortcomings of the thesis.The second chapter is "The main requirements of the Food Safety Law on grass-roots implementation",which mainly introduces the main requirements of the Food Safety Law in grass-roots implementation from five aspects.The third chapter is "The implementation of the Food Safety Law of N County S Town ",which mainly introduces the subject and object of theimplementation of the Food Safety Law of N County S Town,expounds the content of the implementation of the Food Safety Law,and explains the main forms of the implementation of the Food Safety Law.The fourth chapter is "The difficulties and reasons for the implementation of the Food Safety Law in N County S Town".Through three typical cases,it shows four kinds of difficulties in the implementation of the Food Safety Law: "the most severe punishment" is difficult to implement,the traceability system is difficult to implement,the details are difficult to implement,and the channel of problem discovery is limited.Through the analysis,the five reasons are summarized: the publicity and training of the new revised law is not in place,the difference of practitioners' own quality level,the lack of professional level of food regulators,the lack of differential consideration of the legal responsibility of the newly revised law,the lack of government attention and investment.The fifth chapter is "The countermeasures to improve the implementation of the Food Safety Law in N County S Town".Aiming at the difficulties and reasons of the implementation,it puts forward the countermeasures to improve the implementation of the Food Safety Law of N County S Town from five aspects: strengthening the publicity and training,strengthening the supervision,improving the professional level of the supervisors,paying attention to the application of the principle of "equal punishment and excessive punishment" and increasing the government investment.The sixth chapter makes a brief summary of the whole paper and makes a conclusion and prospect.
