Study On The Transfer System Of The Right To Use The Homestead From The Perspective Of Rural Revitalization

The promotion of national comprehensive national strength needs the common development of cities and villages.In order to solve the current problems of rural development,the 19 th National Congress of the Communist Party of China put forward the strategy of rural revitalization,mobilize the development enthusiasm,activate the rural population,land,industry and other elements,develop the rural areas,and realize the Rural Revitalization.In the context of the strategy of rural revitalization,it is of great practical significance to study the transfer system of the right to the use of homestead,make full use of land resources,realize the maximum benefit of resource utilization,safeguard the vital interests of farmers,and promote the modernization of rural agriculture.At present,some areas in our country have made a breakthrough in restricting the transfer of the right to use the homestead.However,due to the lack of explicit provisions and normative guidance of the law,the transfer of the right to use the homestead is very difficult.The proposal of the Rural Revitalization Strategy provides policy guidance for the reform of the transfer system of the right to the use of homestead in China,which is conducive to the improvement of the transfer system of the right to the use of homestead in China.Under the background of rural revitalization,this paper uses literature research,system analysis and empirical research to study the circulation system of homestead use right in China.Through combing the theories of Rural Revitalization and homestead use right circulation,it finds the reciprocal relationship between the two,and analyzes the necessity of circulation with the help of the theories of institutional change,resource optimization and distribution justice and feasibility.In view of the current situation of the transfer system of the right to use the homestead in China and the problems existing in the social practice,such as the legislative concept,transfer channels,resource utilization,urbanization development,etc.,from the perspective of rural revitalization,this paper puts forward feasible suggestions for the improvement of the transfer system of the right to use the homestead in China,first,improve the legislation of the transfer system of the right to use the homestead,break the traditional legislative concept,give the right to dispose of the homestead,revise the relevant laws and regulations,and promote the improvement of the transfer from the legal level;second,standardize the transfer procedure of the right to use the homestead,broaden the channels of the transfer of the homestead,hit the private transfer market,and realize the scientific transfer of the right to use the homestead;the third is to set up a special institution for the circulation management of the right to use thehomestead,improve the comprehensive ability of the managers,and realize scientific management;the fourth is to ensure the implementation of the transfer system of the right to use the homestead,promote the integration between urban and rural areas,break the development barriers,strengthen the publicity of the general law in rural areas,and improve the legal literacy of farmers.
