Ocean warming is a chemical change that occurs after the ocean absorbs carbon dioxide from the atmosphere.It has become one of the main challenges of today’s marine environment.Although the research on ocean warming has not been done for a long time,the negative impact of ocean warming on the marine biodiversity is obvious to all countries.As a cross-domain environmental threat,ocean warming is not only as simple as the governance of the marine environment,but also involves all aspects of marine life and ecosystem protection.For this reason,this research aims to analyze the existing international legal system and try to sort out the systems and methods that can be used to solve the ocean warming problem in different governance systems.The full text is divided into the following six parts:The first part is the preface.This part includes the significance and background of the topic,the literature review,and the innovation of this research.The second part is an overview of ocean warming and marine biodiversity.In this part,this research briefly introduced the concept,impact and countermeasures of marine warming,the concept of marine biodiversity,the development of marine biodiversity protection,and the necessity of studying marine biodiversity protection in combination with marine warming.The following paragraphs make the necessary preparations.The third part is the institutional challenges of ocean warming.In the third part,this research mainly discussed four international environmental legal systems:climate change system,air pollution system,marine pollution prevention system and biodiversity system.This research listed several major international legal documents related to the various systems as reference sources,sorted out the contents of ocean warming and marine biodiversity protection in these four systems,and pointed out the defects of the related systems.It should be reminded that although this research mainly discusses ocean warming from the perspective of the protection of marine biodiversity,ocean warming is a holistic issue and it is impossible to conduct research within the scope of the biodiversity protection system.The important position of the same needs to be clarified,this is the original intention of me to set up this part.The fourth part is the ocean warming and biodiversity protection system.This part is the focus of this research.It is further divided into three parts:the current international legal system for the protection of marine biodiversity,the limitations of the status of marine biodiversity protection in the context of ocean warming,ocean warming,and "Biodiversity Beyond National Jurisdiction"(hereinafter referred to as BBNJ)conservation and sustainable use issues.In this part,it is mentioned that due to the fragmentation of international environmental law,as its implementation faces many difficulties in the international community.To solve these problems,it is necessary to have an integrated governance concept.In addition,to discuss the issue of marine biodiversity conservation,it is inevitable to study the progress of BBNJ.This research also put forward opinions on the content of new implementation agreement.The fifth part is the international law response to ocean warming and its inspiration to China.This part is divided into two small sections:the first section is the international law response to ocean warming,which specifically includes the concept of integrated governance,good at using mitigation,and adaptation measures,focusing on differential treatment and international cooperation;The second section is the inspiration for China.The sixth part is the conclusion. |
