Research On Ensuring The Legislative Power Of Autonomy In Ethnic Autonomous Areas

Our country is a multi-ethnic country,composed of 56 ethnic groups.According to the actual situation in the areas where ethnic minorities live in compact communities,the state has established a system of regional ethnic autonomy to safeguard the equality of all ethnic groups and ensure that ethnic minorities are masters of their own affairs.This system is one of the basic systems in China.The most important right in this system is autonomy,and the legislative power of autonomy is the focus of this paper.On May 31,1984,the law of the People's Republic of China on regional ethnic autonomy was adopted by the National People's Congress.The system of regional ethnic autonomy is a unique political system which protects the rights of ethnic minorities in the form of unifying the state structure.Regional ethnic autonomy system is mainly in the form of the unitary state structure,focusing on the maintenance people in ethnic minority areas in our country politics,economy,culture,political system of the right of the people's livelihood,on the one hand,regional ethnic autonomy system is one of the few have the extension of political and economic autonomy in ethnic minority areas,on the other hand,it also combines general local administrative function of the power,has obvious duality.On the basis of absorbing the experience of China's ancient times and other countries to solve the ethnic minority contradictions,China implements the system of regional ethnic autonomy in line with China's national conditions.After years of practice,this system is in line with the ethnic autonomous areas.At present,based on the actual situation of the ethnic autonomous areas,various ethnic autonomous areas have successively promulgated their own autonomy regulations and separate regulations.However,to a certain extent,when exercising the right of autonomy,the legislative organs of the ethnic autonomous areas,due to a variety of reasons,the formulation of special regulations and autonomous regulations is not based on ethnic characteristics,the quality is low,the quantity is too little,the lack of supervision and so on.This paper refer to the data repository of theoretical research results and the analysis of the current laws and regulations in China,based on the theory of law,by applying the method of ethnic law,constitutional law,sociology and other theories of ethnology,multiple levels and multiple points of view in-depth analyzes the problems in the autonomous areas in the autonomous legislative power,this article on the realization of the legislative power of the autonomy of ethnic autonomous areas,should first embarks from the aspects such as legislation,supervision,standardize the legislative language,perfect the legislative process,improve the quality of legislation,improve the responsibility system,improve the legislative supervision system,to overcome the influence of narrow sector and speed up the separate regulations,formulate,expanding the scope of the special legislation,In order to provide theoretical guidance for the minority areas in the exercise of autonomy and legislative power,to form a stable legal guarantee system.
