Studies Of The Fund Guarantee System Of Two-level Court In Shenyang

The fund guarantee system is the important foundation of the court to fulfill its duties and development,and is also the important means to standardize the court's funds guarantee and ensure the court's work going well.With the development of the funds guarantee and the development of the work of the court,the financial work of the court is becoming more and more responsible,and the requirements are becoming higher.Speeding up the construction of the long-term working mechanism of the court's fund guarantee and financial management is an important measure which could ensure the development of the court centered on the execution of the trial.This article starts with the funds guarantee system of court in Shenyang,analyzes the situation of the funds guarantee in 2016-2017 of the court in Shenyang.And put forward the existing problems in the current system.The "two lines of income and expenditure"implementation and management is not in place,funding support has not been completely out of dependence,funding support standards lag behind.The differences between regional courts and the low utilization rate of provincial transfer payments funds.On this basis,the author puts forward some suggestions on how to perfect the funds guarantee system of courts.Put forward the concrete path and supporting system parallel level solution countermeasure.Implement the court independent budget system,further promote the provincial court funds management work,promote the establishment of standards for the guarantee of court administrative funds and improve the evaluation system of the court funds guarantee,strengthen the central and provincial political and legal transfer payment fund management,provide theoretical basis and decision-making reference for promoting the reform of Shenyang court's funds guarantee and the control of funds.The innovation of this paper is to propose that the financial department should cancel the task of charging the court for litigation expenses,and put forward the suggestion of establishing the performance appraisal system.The shortcomings of the paper is construction and analysis of the index lacking of the comprehensive and thorough,because of the author's theoretical level,researching ability and the limitation of data.
