Military coups caused a more significant challenge for the African Union than other forms of unconstitutional change of government.Coups posed the greatest challenge to the sustainability of the regimes and were a source of political instability in Africa.Although the 1990s and 2000s saw a decrease in the number of military coups,the coup phenomenon is still looming over the African continent.The formulation of a policy on the unconstitutional change of government to combat the unconstitutional change of government,including the coup d'etat,began in 1997 by the Organization of African Unity and then by its successor,the AU.Since then,the AU has adopted reliable legal instruments on the unconstitutional change of government.However,in practice,the OAU/AU response to this phenomenon lacks coherence and uniformity.Hence,this message aims to examine the normative framework of the OAU/The AU on the unconstitutional change of government.It will discuss the response of the AU to the unconstitutional change of government,the legitimacy of change of government through popular uprising under the AU norms on unconstitutional change of government,and the foundations for restoring constitutional order under the AU framework on the unconstitutional change of government.When considering these issues,the thesis examines and compares the AU's response to the 2013 coup in Egypt,where the AU restored Egypt's membership on June 17,2014.However,/the constitutional system has not been formally restored,and the AU's response to the 2019 coup in Sudan,Where the AU re-membership of Sudan on September 6,2019,considering the formation of the transitional government and the signing of the Constitutional Declaration as tantamount to restoring constitutional order in Sudan without holding free and fair elections.The thesis concludes by stating that the AU's response to the unconstitutional change of government contravenes its legal standards.
