Research On Several Criminal Law Issues Of Forest Resources Crime

At present,the lack of protection of forest resources in China's criminal law regulation causes serious damage to forest resources,which will have a serious impact on China's economic development to a certain extent,and will also cause the ecological environment to be viciously damaged,causing great harm to human life.In view of the diversity of the concept of crime,and in order to ensure the pertinence and clear research scope and field of forest resources crime,this paper studies forest resources crime from the perspective of criminal lawt to define forest resources crime,the research content,and summarizes the criminal legislative evolution,so as to draw lessons from it.At present,there are many problems in dealing with forest resources crimes in the criminal law which has been promulgated and implemented in our country.The legislative concept is backward.There are some shortcomings in the conviction and sentencing of the crime of illegal logging,destroying state key protected plants,illegal logging and indiscriminate logging among the existing crimes,which have a huge and frequent impact on forest resources.There is no single crime for the serious forest resource fire and dereliction of duty in forest resource supervision.In view of the problems existing in the legislation,first of all,we should change the legislative concept,establish the idea of taking the environment as the standard,introduce the independent environmental legal interest as one of the legal interests protected by the criminal law,and improve the status of the legislation of forest resources;second,we should perfect the problems existing in the crime of destroying the state's key protected plants,the crime of illegal logging and the crime of indiscriminate logging from the aspects of subject,sentencing and subjective Finally,the crime of destroying forest resources,the crime of causing forest fire and the crime of dereliction of duty in forest resources supervision are set up.
