The important purpose of forcing criminals to accept labor reform is to transform their education into a law-abiding and socially beneficial person.The labor quota of criminals who accept labor reform,as an important means of assessing their labor,is an important basis for criminals to obtain labor compensation.It is an important right for criminals to enter the labor to complete the corresponding labor quota and obtain the corresponding labor compensation.The criminal labor quota corresponds to the labor compensation system and has a positive effect on the protection of criminal labor rights.From the perspective of years of practice and reform achievements,China has not yet formulated a unified system of labor compensation for labor,but the prison administrations of various provinces,autonomous regions,and municipalities directly under the Central Government have even established their own systems for labor compensation for criminals rule.The lack of criminal quota management,the diversification of labor quotas and labor remuneration,and the inconsistency of the supervision of criminal labor quotas corresponding to the labor remuneration system are more common,which is not conducive to the protection of criminals' legitimate rights and interests,nor Conducive to the educational transformation of criminals,and even affect the harmony and stability of society and China's international reputation.It can be seen that studying the labor quota of criminals corresponds to the labor compensation system not only has certain theoretical significance,but also has extremely important social practical significance.It is a very complicated basic work to formulate a labor compensation system for criminals in line with China's national conditions.As a prison law enforcement officer,the author intends to combine his own prison law enforcement practice,from the perspective of the current situation of labor compensation for criminals in Fujian R prison,starting from the distribution of labor quotas for labor compensation,and analyzing the labor quota for criminals.The dilemma faced by the remuneration system in practice,and the following views on how to construct a complete criminal labor quota corresponding to the labor remuneration system in China:China should standardize the prison management model,standardize the labor quota system standard and the labor remuneration extraction method,and unify the legal framework.Strictly implement the process,improve supervision and other aspects,and build a system of labor compensation for criminals in accordance with China's natio nal conditions.In addition to the introduction,the full text includes the following four parts:The first part describes the meaning and characteristics of the labor quota for criminals and the significance of establishing this system.First of all,it explains the concept and characteristics of criminal labor quota.Secondly,it expounds the meaning and characteristics of criminals' labor compensation.Thirdly,it explains the meaning of the criminal labor quota corresponding to the labor compensation system.Finally,it discusses the theoretical significance and social practical significance of the labor compensation system corresponding to the formulation and implementation of criminal labor quota.In the second part,from the perspective of the practice of establishing the labor quota for criminals in Fujian Province,this paper analyzes the current situation of labor compensation system and its practice in China,and analyzes the current practice of labor compensation system for criminals in China.The main flaws in the aspect:it has both the defects in the prison system,the flaws in criminal policy,and many other defects.Therefore,it provides materials for discussing how to construct a labor compensation system for criminals in accordance with China's national conditions.In the third part,by investigating the labor remuneration system corresponding to the labor quotas of the two major legal systems,this paper explores the useful experience for China to formulate and implement the labor remuneration system corresponding to the criminal quota.The two major legal systems have different systems for the labor quotas of criminals,but they are worthy of reference in the following aspects:through the national legislation,clear and specific provisions are made on the labor compensation system for criminals,so as to guarantee the authority of the system.Sexuality;the production of prisons is guaranteed by both the state and the society.The purpose of prison production is limited to making the offenders better able to adapt to the society after they are released from prison.Social donations are an important source of prison production funds;labors corresponding to the completion of labor quotas for offenders The right to remuneration and the scope of use shall be stipulated accordingly.The labor remuneration shall not be handed over to the offender himself.Most of the remuneration for the period of serving the sentence,the performance of the property-type judgment,and the reserve fund used after the release shall be used separately.The fourth part,taking the new pattern of criminals' "five major reforms" as the starting point,puts forward the following ideas for perfecting the labor compensation system of our criminals:China should formulate a more unified criminal labor quota corresponding to the labor compensation system;continuously optimize the criminal labor quota corresponding The evaluation system of the labor compensation system;strictly regulate the implementation procedures of the system;improve the supervision and implementation system of the system.Therefore,the labor rights and interests of criminals are effectively guaranteed,the development of prisons is promoted,and the education of criminals is finally transformed into a law-abiding and socially beneficial person.
