As one of the most basic and important social economic and legal relationship under the conditions of market economy,labor relationship is playing a vital role in the economic development and social stability of a country.In recent years,with the deepening of the reform of the market economy system and the continuously adjustments of the industrial structure and the management methods,all kinds of the economic relations have been becoming increasingly complicated,which reflects on the aspect of the labor relations is that the labor disputes are increasing both in number and in complexity every year.As the pivotal part of the system of labour dispute settlement of China,the System of the Labour Dispute Arbitration and Litigation has been undertaking the important duty to process procedures and standard solutions for most of the labour dispute cases.Recently,as the penetration and the implementation of the thought of rule-by-law in the public administration and social management of China,the judicial ways or arrangements to solve labour disputes have been paid more and more attention.However,the current System of the Labour Dispute Arbitration and Litigation has gradually exposed some obvious problems internally or externally,thus it can not meet the objective needs of the changes of the labour dispute in the new period.Therefore,it is necessary to analysis the existing problems and puts forward improvement suggestions of the system.This thesis attempts to make a goal-oriented analysis and value assessment on the status and the nature of the System of the Labour Dispute Arbitration and Litigation,and interaction relationships of the other Systems of the Labour Dispute Settlement of fairness and efficiency in the multiple perspectives of theories of the management,law and economics.Moreover,it makes an analysis on the relevant system arrangements of the other countries so as to put forward constructive suggestions on the reform of the System of the Labour Dispute Arbitration and Litigation in China.
